The preamble of the Indian constitution read as, ‘WE THE PEOPLE OF INDIA’… further grand themes like JUSTICE, LIBERY AND EQUALITY of status has been highlighted with utmost care. Further ‘DIGNITY OF THE INDIVIDUAL’ has been asserted. The tone of the preamble sets the ethical and legal framework to create an atmosphere in the country where all human being can live with their realized potential and dignity. However, reality is appalling. Justice is elusive (inaccessible, long delays, corruption, political influence) to the majority of the downtrodden and untouchables. Liberty (freedom of expression) is at stake, such as:

1. On 26th June, 2012 Ms. Shirin Shabana Khan, senior member of management committee of PVCHR posted in Odisha Watch an article published in Asia News. This article includes the quotation of Dr. Lenin Raghuvanshi on Kandhamal issues. After more than a month three gentlemen (Mr. Saubhagya Panigrahi, Mr. Chinmaya Kumar Panda and Mr. Bahara Mihir Mohanty) from Odisha attacked on her religion identity.
2. Shruti Nagvanshi was struck down in the ground and villagers were beaten by Guddu Dubey, known for his links to the underworld in Ahirani Nathaipur, Block – Baragaon under Phulpur Jurisdiction, Varanasi.. After they complained that a social audit was being fabricated, and that many of their names were being misused. The audit was to look into the operation of the Mahatma Gandhi National Rural Employment Guarantee Act, 2005 (MNREGA), which is operated by the Village Panchayat. We have also learned that although the office of the village head was reserved for a female candidate and was won by the wife of a local landlord, it is her husband who runs the village.

Lalji and Mr. Magala Rajbhar, an activist associated with the PVCHR, tried to intervene and keep the peace, but were beaten by Singh. The BDO called off the meeting and made moves to leave. When asked to call the police by two female PVCHR staff members (Ms. Shruti and her sister Ms. Anupam), he claimed that he would rather report it personally. Shruti requested that she and Lajli go with him and the three tried to leave, but a mob of upper caste men led by Singh reportedly surrounded the vehicle and demanded that Lalji get out. At this point Mishra allegedly pushed Lalji out of his vehicle, and Shruti followed, fearing for his safety. The two were beaten, and one man, Guddu Dubey, known for his links to the underworld, struck Shruti to the ground. Villagers were able to intervene and the two victims were taken to Phulpur Police Station to make a report.

3. Dr. Lenin Raghuvanshi was detained under Section 151 and released after four hours while the other three activists were charged under Sections 107/16 for the legal proceeding. As on 8 August 2003, the children held a Child Parliament in front of the district headquarters and demanded a school in their area. On 26 August 2003, observed as tehsil diwas (day), 250 children walked 5 km from the Sant Kabir Jan Mitra Kendra to Pindra tehsil and submitted their demand to the SDM of Pindra. The SDM misbehaved with the children and ordered a lathi-charge on the children and the villagers.

Rajendra Tiwari, present village head of Belwa village, does not plan to open any school for the Musahars he engages as bonded labourers in his brick kiln factory. Even the BRC co-ordinator in his report stated that 211 children were present in the brickfields and this ghetto was marginalised due to politically biased enmity.

In 2007 false charged imposed on Dr. Raghuvanshi and his colleagues under Section 505(b) were highlighted by NDTV in a special news report. It was aired in India, United Arab Emirates and the United Kingdom on 10 December 2010. As the national media wrote front-page editorials, the electronic media gave wide coverage to the issue by allotting prime time news coverage to these cases.

The state administration, meanwhile, haphazardly responded to the issue. Its response was in two different directions, unfortunately opposing each other. Once the appeals were issued, the administration immediately dispatched some of its senior most government officers to the remote villages to study the situation. In one such case, some of the top officers literally flew into Anei village at Varanasi in a helicopter. Anei is the village from which the Jigar case was reported. The officers, under the direction of the chief minister’s office, took immediate steps to ensure that there would be no further starvation deaths in the village. The officers made overnight arrangements to measure the land and even allotted land to the lower caste community in the village within hours.

Various political parties in the state picked up the issue of starvation and malnourishment. Rahul Gandhi, a Member of Parliament from Uttar Pradesh, came to know about the case of Mukesh from Jaunpur district and made arrangements for his treatment at the All India Institute of Medical Sciences (AIIMS). Mukesh was shifted to AIIMS and is now receiving treatment there. While this was going on, the chief minister appeared on television and gave a statement that the reports made by PVCHR and AHRC concerning starvation and deaths from malnutrition were false. Simultaneously, I started receiving threat calls on my mobile phone.

One Rajendra Tripathi has filed a complaint against him and his colleagues at the Phulpur police station making false allegations against PVCHR and myself. Tripathi, the head of Belwa village who is also the complainant in the case, is a person against whom I, in the past, as the member of the District Vigilance Committee against Bonded Labour, filed complaints, based on which there is a warrant of arrest issued by the magistrate’s court. The arrest order is pending against Tripathi. The FIR states that Tripathi himself reported at Phulpur police station along with his brother, and has given the First Information Statement.

The applicant Mr Rajendra Prasad Tripathi, son of Raj Narayan Tripathi is a resident of Belwa village within the jurisdiction of Phulpur police station of Varanasi district. He is a peace loving person. In the applicant’s village, now Dr Lenin Raghuvanshi, Ms Anupam Nagavanshi and Ms Shruti Nagavanshi of village Pandeypur and Daulatpur and Mr Prem Nut, son of Mahangu, Ms Kalawathi, wife of Sherbahadur of Belwa are running various NGOs – Jan Mitra Nyas (funding organisation), People’s Vigilance Committee on Human Rights, Sawitri Bai Phule Samiti, Bagath Singh Youth Singh Samiti, Voice of People, etc. They are giving fake assurances and attractions to the illiterate and poor people in the name of money, Anthyodaya Anna Yojana Card (AAY card), housing, pension, allotment of land and jobs and they are earning money. They have compelled the villagers into class conflict and are interfering in the village committee politics by agitating the villagers by provocative speeches. It is their work to gather against the administration and other respected people of the village and they regularly conduct gherao in the district head quarter and against other high officials.

The above people and their NGO’s work is to create class conflict and lawlessness. If legal action is not taken against the above people, the situation of conflict and disorder will be created. Sir, I urge you to take legal action against the above people so there could be peace in the village.

The complaint reflects the worry of a Brahmin who finds his family’s thus far unchallenged domination upon the lower caste being challenged. The accused persons in the complaint also include members of the Dalit community. The mere fact that the complaint is false and made with malicious intention calls for action against the complainant under provisions of the Indian Penal Code, 1860 and also under the Scheduled Caste and the Scheduled Tribe (Prevention of Atrocities) Act, 1989.

The allegations of ‘making promises’ are false. Free speech is a fundamental right in India, so is the freedom to associate. The registration of the crime based on this complaint will amount to registering a crime for exercising a person’s fundamental right guaranteed in the Constitution. This ground of the complaint has no legal basis whatsoever.

In spite of repeated reminders, the Phulpur police refused to produce anything in court. Even though the law mandates a report to be filed by the police in court within 48 hours, the police filed a report after 10 days informing the court that a crime has been registered. Meanwhile, the PVCHR activists against whom the crime was registered also appeared in court, informing it that they are present within the jurisdiction of the police and in public in case the police wanted them to be arrested. The police, however, refused to arrest them. Ironically, PVCHR has also been requested by the state police department to address their senior officers on human rights principles in a meeting organised by the state police department in Varanasi on 28 January 2008. In December 2007, the PVCHR staff and the chief minister of Uttar Pradesh even had a live discussion telecast regarding the issues of starvation and hunger of Dalits in the state.

In fact, in August 2005, PVCHR promoted a contest against the candidature of Tripathi as the village head in the local election. Tripathi immediately responded by ordering Ramasray Singh, a local criminal, to call the candidate S N Giri and me over telephone saying that he has been asked by Tripathi to kill both me and Giri for promoting a competition in the village election, which thus far was never contested. Against this, the AHRC issued an Urgent Appeal, which was responded to by three rapporteurs from the United Nations, who wrote to the Government of India to provide protection to Giri and me. The Election Commission of India also responded to the appeal by sending their representative to monitor the election and ordering the then District Magistrate to provide every security to Giri and also to the Dalit voters during the election. A criminal case was registered against Ramasray Singh and he was arrested. The District Magistrate also issued shoot-at-sight orders against the criminals sponsored by Tripathi, if they tried to prevent the Dalits from participating in the electoral process. Due to this, for the first time since Independence, the Dalits in Belwa exercised their right to vote.

4. Mangal Singh son of Ghasite resident of Vishal Nagar, district Mahoba of Uttar Pradesh. Mangal Singh, a farmer is fighting against the illegal mining & heavy blasting activities near town Kabrai Mahoba district, which has affected the residents of that areas. He has filed PIL in Honb’ High Court, Allahabad CIVIL MISC. WRIT PETITION NO 63396 OF 2009 that turned the stone crusher association against him. On which Mangal Singh sought security from Honb’ High Court. The Honb’ Court ordered but till now he did not get any security.

5. Ms.Rehana Adeeb, founder of ASTITWA (Action Social team for Women) Social Organization in Purkoji Street, District Muzaffarnager of Uttar Pradesh. Her organization starts having friendly relation with Muslims and dalits women and share their high and lows faces in their life and experience how they individually struggled in their life and run their families.

Astitwa is making effort with this aim and some people or some groupis strictly opposing it because they are in the fear of seat and they are playing politics in the name of religion and women. They are raising their voice and doing against Astitwa because they are feared of political game will be ruined. For example provoking with worker, forcefully taking money by entering in office, showing vulgar picture and mentioning it on the piece of paper to women worker, communicating on the mobile etc. several times it was complained in the police station but police respected people of the society unite for doing harassment. Administration entirely oppositely behaving with us “they are already in trouble and we also came to troubled them”. In this situation it is very challenging to work. Entire day she work in the field because her house is 90 Km far from my work place. It is very dangerous to sleep alone in the office. Female colleagues help her in day during her work but she is alone in the night.[iii]

6. Mr. Mahesanand, Secretary, Gramya Swaraj Samiti organized protest march from Dudhi tehsil to Robertsganj district header of Sonbhadra. In which five thousand tribal will cover 100 km starting from 10- 15 March on the resolution taken by villagers of Sundari on 15th January, 2011 after inauguration of Kanhar Dam. He faced threat from the local contractor, state and political parties.

7. When the world recognises and shows solidarity with the non violent protest of Irom Sharmila, that entered into the 10th year for demanding establishment of rule of law and repeal of AFSPA entirely from the State, the political system both in Delhi and Manipur get into the brass task to undermine the strength of non violence through their silence and ignorance. Her’s is the longest protest for a social cause by any single individual anywhere in the world. Reacting to her hunger strike, and the public support across the globe, the frustrated Mr Okram Ibobi Singh, the Chief Minister told in the Manipur State Assembly that the State Government had to spend around Rs 147,000 in two years to keep Sharmila ‘alive’. We are sure; the Britishers never said such thing against Gandhiji. Neither the security agencies, nor the political class have learned the meaning and experience of non violence, except using it as a debit card.

8. The reign of terror was such that even listening to Azad Jammu & Kashmir (AJK) Radio Station would lead to public beatings and incarceration. “There were lots of stories in our childhood about sending behind bars anyone caught murmuring signature tune of AJK radio-today many have put this as ring tone in their cell phones. Those days it was seditious to tune in any other radio station other than the Radio Kashmir. We heard stories about sleuths eavesdropping and people being cane charged and even fed with hot potatoes by dreaded cops for listening to AJK radio”.

9. Police firing in Paramakudi area of Ramanathapuram District, Tamil Nadu, on 11September 2011, in which 6/7 persons died and several injured. Pursuant to the directions of the Commission to the DGP, Tamil Nadu, the SP, Ramanathapuram District, has sent his report dated 29.02.2012. As per this report, Crime No. 300/11 U/S 147/148/149/427/324/435/332/307 IPC and Section 3/4 of the TNPPDL Act, was registered at Town Police Station of Paramakudi on the incident in question. Vide Government Order dated 29.11.2011 the investigation of the case has since been transferred to the CBI. The report further says that the State Government has appointed a one man Commission of Inquiry, headed by Justice Shri Sampath, a retired Judge of the Madras High Court, to conduct an inquiry into the incident. The report is yet to come. The report further says that vide Government Order dated 29.11.2011, the State Government has announced relief of Rs.5 lakhs each to the NOK of the deceased persons. The Chief Secretary, Government of Tamil Nadu, is directed to inform the Commission of the status of the inquiry by the Inquiry Commission within four weeks. He should further forward to the Commission proof of payment of the announced relief to the NOK of the persons who died in the police firing. The Additional Director, CBI, Chennai, is also directed to inform the Commission of the current status in the case within four weeks.

Dr. B.R Ambedkar rightly says “Indian today are governed by two different ideologies. Their political ideal set in the preamble of the constitution affirms a life of liberty, equality and fraternity. Their social ideal embodied in their religion denies them”

Therefore it is an appeal to Government of India to assert the Liberty (Freedom of Expression) and to invite UN Special Rapporteur on the Rights to Freedom of Peaceful Assembly to visit to India.

Sub : Discrimination on the basis of caste against Sh. Baldev Raj Mahi Ex- Manager , PNB Usmanpur , Distt Nawashahr , Punjab.
Sir,
1) It is submitted that when I took over the charge as branch Manager at Usmanpur, the performance of the Branch was at its lowest deposit of figure of Rs. One Crore Thirty Lakh and Credit was at One Crore Fifty Six Lakh. I did my work honestly and diligently and took the performance of the Branch to its new high ( i.e. desposit of Rs. Ten Crore Seventy Five Lakh and Credit of Rs. Nine Crore Eighty Lakh)
2) During business review meeting DGM Circle Head Office Hoshiarpur has declared that I would transfer the officers by keeping performance of the branch in mind and those who are good performers will be given branch of their own choice and suitability. But my transfer has been done ignoring my hard work and performance only due to being a Scheduled Caste Manager and Discriminated against me.
3) My work at Usmanpur branch stood first in the Distt. and 5th number in circle. In my branch each and every activity was done as per bank norms and nothing has been done fraudulently.
4) Only due to misreporting by Sh,Jaswinder Saini LDM on the directions of Sh.M.S.Nijjar AGM. Both those officers are ill treating me due to their past personal grudge. Both these officers have shown and presented a bad performance of Usmanpur Branch intentionally.
5) Both these officers as explained in previous paragraphs intentionally and deliberately harass me on flimsy grounds and tarnish my image in the eyes of my superiors.
6) It is submitted that I Sh. Baldev Raj Mahi Ex- Manager , PNB Usmanpur , Distt Nawashahr , Punjab belongs to Schedule Caste category. On the basis of my caste, the then AGM, Circle Office Hoshiarpur Sh M.S.Nijjar Discriminated, harassed and in a revenge full manner acted against me only to tarnish my image in the eyes of my superiors. Sh.M.S.Nijjar has some personal grudge against me because he over stepped his powers when he transferred me from Banga branch while working as S.R.M Jalandhar . Then Zonal Manager Amritsar took the notice of the transfer and ordered to keep this transfer in Abeyance and also called the explanation of Mr.N.S.Nijjar.
Since he is working against me and trying to tarnish my image as well as trying to entangle me in one way or the other way. Only from this point he started acting in a whimsical manner against me.
7) I and my wife are ill despite my illness. I have been intentionally transferred to Hoshiarpur during the period of March closing and inspection period, so that I cannot remove irregularities during inspection.
8) I was not allowed to sit in the computer examination and not called me for interview and training which is compulsory for Schedule Caste category. When I was eligible both channel 1 and 2
9) Since April 2009 August 2009 my salary was not been released. My overdraft account has been freezed. Due to this I was unable to get proper treatment to myself and my family members. I was even unable to pay school fees of my children. My wife died due to non availability of funds.
10) Deliberately false case (F.I.R) has been lodged against me only to tarnish my image. There is nothing wrong happened in this case. My whole family is disturbed. Wrong enquiry report submitted by Mr.G.L.Sharma Senior Manager on the Instruction of Mr.Nijjar who has not called me in the enquiry and submitted one sided enquiry report. I requested the DGM office Hoshairpur to conduct re-enquiry from other circle above the rank of Sh.M.S.Nijjar, The then AGM. But nothing was done. This charge was included in the charge sheet issued to me but was unproved in the detailed enquiry conducted by Sh.Jagdiah Rai Senior Manager.
11) Casteist remarks were made against me by Sh.M.S.Nijjar AGM Circle office Hoshiarpur.
12) After some time Dr. B. L.Pathija proceeded on leave . M.R.Nijjar who was officiating as circle head ordered special inspection of BO Usmanpur . It was given to Sh. Jaswinder Saini , Manager, LDM Hoshairpur.
13) Sh.Jaswinder Saini was having already a grudge against me because when i was working as incumbent incharge at Behloor Kalan , Loan sanctioning power was vested in me and Sh , Jaswinder Saini was working as a recommending and processing authority . I received many complaints from borrowers that he was getting illegal graft from the borrowers of Agriculture Loan . I have pointed out this matter to Sh. Jaswinder Saini . That’s why he was malicious towards me. Branch inspection was going on and during the inspection I was relieved to join at PNB LDM Office Hoshiarpur . I was not given the opportunity to remove the small irregularities and verbal instructions were issued to the Inspector to make me scape goat .Even small mistakes which could be easily rectified , are presented to the management in such a way that it looks as Major Irregularities , If i was not relieved during Inspection these small mistakes / errors could be rectified .
14) Sh .G.L.Sharma investigated the Branch for sanction of Education Loan . He had not asked for my comments in the above investigation and submitted his false and fabricated report , without any evidence , baseless report on the verbal instructions of Sh.M.S.Nijjar . I have not been issued any tabular Performa as per Bank guidelines, no explanation was called and a direct charge sheet was served upon me on 5 / 10 / 2009 . I asked for relevant documents to submit my defence against the charge sheet . It was not provided to me . I am afraid to say how without relevant documents it is possible for me to make my defence . The charge sheet was prepared by Sh. Chander Shekhar Gautam , Sh . S.K.Sharma, Sh. Bajaj chief manager and other concerned officials who all were from General Category . They all followed the verbal instructions of Sh.M.S.Nijjar , Sh. Jaswinder Saini , Sh. G.L.Sharma , Sh. Chander Shekhar Gautam , Sh.S.K.Sharma , Sh. Bajaj who all discriminated against me on the basis of caste as i belong to Scheduled Caste . I have filed a case against Sh.M.S.Nijjar for calling me names on the basis of my caste which is still pending in the civil court Nawashahr Doaba ( Punjab ) .
15) I have also made a complaint to the chairman national commission for Scheduled Caste , New Delhi on the basis of my caste . The authority ( D.A.) Sh.S.S.Arora (DGM) appointed Sh. Jagdish lal senior manager and Sh . Jai Ram manager as E.O. and P.O. respectively . Both of these officers though belong to S.C category but both of them were under the influence and pressure and stress of authority (D.A.) as their promotions were due and both of them need undue help from the D.A.
16) Both of these officers worked against my interests to serve their own vested interest . Both of them did not grant me fair and ample opportunity to cross examine the witness and was not allowed me to exhibit my defence documents . The whole enquiry was conducted on the verbal instructions of D.A. Sh.S.S.Arora ( DGM) to make me scape goat .
17) The whole enquiry was not fair and impartial . P.O. Sh. Jai Ram submitted his briefs wrongly without any evidence and on baseless documents on the verbal order of the D.A. Sh. S.S. Arora (DGM).
18) I submitted my reply on P.O. briefs .E.O. Sh.Jagdish lal did not consider my reply as genuine and submitted his report on the verbal order of the D.A.Sh . S.S.Arora (DGM).
19) Even the charges which were not proved in the enquiry proceedings were proved against me baselessly without any documentary evidence only to tarnish my image in the eyes of superior authority and to make me scape goat . The whole case is absolutely based on discrimination against me on the basis of caste and arbitrary use of authoritative powers to do injustice against me . The whole general category officers acted against me only to spoil my career
20) IT IS BOUGHT TO YOUR KIND NOTICE THAT VIDE PAD CIRCULAR NO. 16 AT 10/1/2011 SCHEDULE TO THE DISCIPLINE & APPEAL REGULATIONS, 1977- DESIGINATION OF DISCIPLINARY AUTHORITY AND APPELLATE AUTHORITES WERE ANNEXED.
21) ACCORDING TO THESE GUIDELINES I WAS WORKING IN THE SCALE OF MMG-II (MANAGER) ACCORDING TO WHICH MY DISCIPLINARY AUTHORITY WAS AGM WORKING IN THE CIRCLE OFFICE HOSHAIRPUR. ONLY TO PUNISH ME IN PRE-DETERMINED MANNER BANK GUIDELINES AND PROCEDURE WAS NOT ADOPTED & I WAS GIVEN PUNISHMENT BY DGM WHEREAS AGM WAS STILL IN OFFICE.
22) I QUOTED VARIOUS JUDGEMENTS OF HIGH COURT/ SUPREME COURT IN SUPPORT OF MY DEFENCE, NO BODY HAS TAKEN CARE OF THESE JUDGEMENTS & ACTED IN AN ARBITRARY & PRE-DETERMINED MANNER ONLY TO PUNISH ME.
23) I have come to know from relievable sources that this complaint has been marked down to circle office PNB Hoshiarpur and the same officers who have wrongly presented my case , is again dealing with my complaint regarding reinquiry.
24) MOST URGENT :- “THAT INSPITE OF SEVERAL NOTICES AND WRITTEN REQUESTS PROPERLY ACKNOWLEDGEMENT BY THE BANK , THE BANK HAS NOT PROVIDED ME DOCUMENTS AND THE LIST OF PROSECUTION WITNESS ON WHICH THE CHARGE SHEET WAS BASED . THEREFORE PROCEEDINGS CONTINOUED WITHOUT PROVIDING THE DOCUMENTS ARE NULL AND VOID.”
25) That I had visited the branch B.O. Usmanpur for verification of record because the Disciplinary Authority did not provide the listed documents along with the charge sheet. I tendered an application to the branch manager for providing me photocopies of the listed documents, so that I could prepare my defence statement properly. But the Branch Manager refused to provide me the photocopies of the said documents due to which I was unable to prepare my proper statement of defence. It may be seen that neither the Disciplinary Authority provided me the photocopies of the documents nor the branch manager whereas, I was advised to submit my defence statement. This issue was raised in my appeal but the Appellate Authority did not appreciate the evidence on record and instead of addressing the issue on merit he has stated differently that I did not submit my defence statement relating to the charge sheet. Thus, the order of Appellate Authority is non-speaking, arbitrary and perverse. “THAT INSPITE OF SEVERAL NOTICES AND WRITTEN REQUESTS PROPERLY ACKNOWLEDGEMENT BY THE BANK , THE BANK HAS NOT PROVIDED ME DOCUMENTS AND THE LIST OF PROSECUTION WITNESS ON WHICH THE CHARGE SHEET WAS BASED . THEREFORE PROCEEDINGS CONTINOUED WITHOUT PROVIDING THE DOCUMENTS ARE NULL AND VOID.”
26) That with regard to charge no. 4, I had submitted in my appeal that neither this loan was sanctioned by me nor it was renewed by me nor I was posted at B.O. Usmanpur on 17.5.2005 and thus, the allegation was not remotely attributable to me. It may be seen that on 17.5.2005, I was posted in a different branch i.e. Rahon.
27) 1. That the order of penalty has been passed by the incompetent authority.
28) It is submitted that in terms of PAD Circular No. 16 dated 10.1.2011, the Head Office has scheduled and designated the Disciplinary Authority as well as Appellate Authority w.e.f. 10.1.2011, according to which, the Asstt. General Manager in the Circle Office has been designated as Disciplinary Authority and in case, the Asstt. General Manager is not posted then the Deputy General Manager would be the Disciplinary Authority. In the present case, the Asstt. General Manager Mr. K.V. Anand was posted in the Circle Office and he was designated as Disciplinary Authority. But in my case, the Deputy General Manger Sh. S.S.ARORA has passed the final orders dated 6.7.2011 in violation of PAD Circular No. 16 dated 10.1.2011. It is a settled law that when the order has been passed by the incompetent authority then, the same is vitiated being illegal and not liable to be sustained.
29) I was in abroad against sanctioned leave and this entry has also been made in my passport. For the purpose of brevity the photocopy of the passport is also enclosed as Annexure-A thereby proving that I have visited England during the period 14.9.2007 to 29.10.2007.

30) I am failed to understand how these general category officers will present true picture w.r.t. my complaint and write some material against themselves. If no justice is being done to me i will lodge a complaint against all these general category officers to CBI, CVC, ( INDIA )Finance ministry, Govt. of India and President of India.

31) 1) Most of the charges which were proved against me while I was away to a foreign country. My leave was duly sanctioned by competent authority which is on record. This fact has been concealed by lower authorities from your good self. Copy of Passport is enclosed herewith for your kind perusal which clearly shows that during this period I was away from India.
32) 2) On 17/5/2005 I was posted in BO Rahon and charges relating to this period have been proved against me, how this is possible to prove charges against me and not against the manager working in BO, Usmanpur my predecessor.
33) All loan A/cs has been fully secured with collateral security and there is no apprehension of loss to the Bank. These facts has been wrongly communicated to yourgoodself by the officers who belongs to general category who all discriminated me on the basis of caste as I belong to scheduled caste
34) That I always received meritorious and appreciation letters for my working as Incumbent Incharge.
35) That my track record has been unblemished.
36) That I had already put clean and clear service of 27 years in the bank and thus, it was necessary to see my track record of 27 years period.
37) That there is no fraud in any of the cases except at the most may be foolish bonafide inadvertent procedural lapse, if any.
38) That my wife has since been expired after prolonged expensive illness.
39) That I have no son to take care of my family affairs.
40) That I always received meritorious and appreciation letters for my That I have three daughters for their education and marriage.
41) That I am suffering from the disease of Flaria which is uncureable.
42) That I have no other source of income.
43) That I do not have any past savings or funds in any shape or form or even I am not in a position to continue my family members with food, clothing, education, medical care and to discharge all other social and substantial and subsistent requirements for survival and to live with honour and dignity in the society.
44) All sympathies as human being are required.
45) That I was not the only person in the branch whereas all other officials have been exonerated for the same course of lapses and only I have been discriminated in the matter.
46) Than an opportunity of personal hearing may kindly be accorded under the principles of natural justice, even if the same is not provided under any of the Regulations, so that I may be heard properly, patiently and sympathetically.
47) That a lenient view may kindly be taken in the matter because at this age of about 50 years, I am unable to get employment anywhere whereas my wife has already expired, I have three daughters who are school and college going requiring financial assistance for their education and marriage whereas I am already suffering from Flaria in my leg which is un-cureble in the medical science. I have no other source of income whatsoever it may be and at the same time, I do not have any deposits or saved earnings in the past because lot of expenditure was incurred on the treatment of my wife etc

48) It is prayed to order the re-enquiry in the whole case to bring to light the truth behind the whole case and to provide me justice . It is requested to order re-enquiry from the impartial and honest officer from the circle office other than the circle office Hoshiarpur to give me due justice.
